Dilapidations

An expert opinion to solve your dispute

Our experienced surveyors can help you navigate the complex laws surrounding dilapidations, whether you are a landlord or a tenant. We can assist at all stages of the process, from preparing dilapidations schedules and dealing with repairing covenant issues to helping with discussions and negotiations to give you the best chance of success.

What are Dilapidations?

Dilapidations refer to the breach of a condition (covenant) of a lease relating to the state of a property. Upon taking up commercial leases, tenants agree to keep the premises in good repair. Failure to do this can result in a landlord serving a schedule of dilapidations on a tenant, to either seek to recover from the tenant the cost of making good the disrepair, or to request the tenant to undertake the necessary repairs to bring the property back to its original condition.

We can help with:

  • Undertaking a detailed survey of the property to establish the condition of the building and analysis of repair items listed in the covenant
  • Preparing dilapidation schedules
  • Dealing with repair issues outlined in the covenant
  • Assist with negotiations between Tenant and Landlord

Howe Chartered Surveyors can assist with the above and will aim to secure a positive outcome for all parties involved for any mitigating claims.
