What are Dilapidations?
Dilapidations refer to the breach of a condition (covenant) of a lease relating to the state of a property. Upon taking up commercial leases, tenants agree to keep the premises in good repair. Failure to do this can result in a landlord serving a schedule of dilapidations on a tenant, to either seek to recover from the tenant the cost of making good the disrepair, or to request the tenant to undertake the necessary repairs to bring the property back to its original condition.
